Terms & Conditions
Prices and Currency
All prices are stated in EUR (Euro) unless otherwise specified. Prices include applicable VAT in accordance with EU regulations, unless explicitly stated otherwise.
Delivery Time
Estimated delivery time for pre-orders is approximately four (4) months from order confirmation.
Delivery times are indicative and may be adjusted due to production scheduling, quality control procedures, or logistics factors. In case of significant delay beyond the estimated delivery timeframe, the customer will be notified without undue delay and offered the option to cancel the order for a full refund.
Pre-Orders
A pre-order may be cancelled at any time before production of the relevant batch has commenced.
Once production has commenced, the order becomes binding, subject to mandatory consumer protection rights under applicable law. Orders are accepted subject to available production capacity and are fulfilled in controlled production batches.In case of significant delay beyond the estimated delivery timeframe, the customer will be offered the option to cancel the order for a full refund.
Payment
Payment is authorized at checkout and completed upon dispatch of the product. No funds are withdrawn before shipment. Payment is only captured once the product is ready for dispatch. No payment is captured prior to shipment.
Right of Withdrawal
After delivery, the customer has the right to withdraw from the purchase within fourteen (14) days from receipt of the product, in accordance with EU consumer protection law. To exercise this right, the customer must notify Gearrista within the withdrawal period.
Returns and Refunds
For pre-orders, customers may cancel their order at any time before production has commenced and receive a full refund. In case of significant delay beyond the estimated delivery timeframe, customers will be offered the option to cancel their order for a full refund. Returned products must be handled with reasonable care and returned in a condition suitable for resale, including original packaging and all included components. The product must be returned without undue delay and no later than fourteen (14) days after notifying withdrawal. Return shipping costs are borne by the customer unless otherwise required by mandatory consumer protection law. Refunds are processed using the original payment method. Further details are described in the Refund Policy. We may withhold the refund until the returned product has been received or documentation of return has been provided.
Transfer of Risk
Risk of loss or damage passes to the customer upon physical delivery of the product.
Limitation of Liability
To the extent permitted by applicable law, Gearrista ApS shall not be liable for indirect or consequential damages. This limitation does not affect statutory consumer rights.
Force Majeure
Gearrista ApS shall not be liable for delay or failure to perform obligations due to circumstances beyond reasonable control, including but not limited to events beyond reasonable control such as severe supply chain disruptions or external logistics interruptions.
Governing Law and Jurisdiction
These Terms & Conditions are governed by Danish law. Disputes shall be subject to the jurisdiction of the Danish courts unless mandatory consumer protection law provides otherwise.
